To ALL ASCONIANS!

Last year, it came to our knowledge that a duplication of name in the SEC Registration bearing the name of ALPHA SIGMA CHI OMEGA 1958 (ASCONIAN) – Intercollegiate Fraternity & Sorority, Humanitarian Service Inc. with SEC Registration no. 2024120180469-01 with a Cebu City address was cited in SEC online database.

In our investigation, the said name is indeed registered on December 10, 2024, in SEC Cebu. We submitted our letter of complaint to the SEC Cebu branch informing them of the situation (duplication of names, similar or identical names).

Under the Revised Corporation Code of the Philippines, particularly Section 18, if two corporations have similar or identical names that may cause confusion in the marketplace or mislead the public, the Commission has the authority to direct a name change. Specifically, the provision mandates that:

“A corporation must have a name that is distinct and not similar to any existing corporation name that could cause confusion. If a corporation’s name is found to be identical or confusingly similar to another, the SEC may direct the offending corporation to change its corporate name.”

It is crystal clear that this new name registered recently in the Security Exchange Commission, Philippines violated the above law. In addition, we believed they are not ASCONIANs or whoever they are, and who’s behind the SEC registrations of the said “offending corporation” ALPHA SIGMA CHI OMEGA 1958 (ASCONIAN) – Intercollegiate Fraternity & Sorority, Humanitarian Service Inc. because they did not ask permission from the incorporators or even do due diligence from their side.

Whereas, the principal name of ALPHA SIGMA CHI OMEGA 1958 CORPORATION was officially registered on January 18, 2023, and complied with the SEC processes and reportorial with the approval of the senior ASCONIANS since the planning of the registration started. The second registered name (duplicate name) is obviously to create confusion among members and now the incorporators are looking forward to appropriate actions for this incident.

Therefore, the EXECUTIVE COUNCIL, who are composed of incorporators, will publish the notarized EXECUTIVE ORDER 01 which was resolved last year. This is to give awareness and warning to all members of further confusion and might lead to bringing our beloved ALPHA SIGMA CHI OMEGA into untoward events beyond our control that might cause harm to our organization and the members in general.

The purpose of this is to safeguard and protect from any anomalies and other evil thoughts to degrade our organization.
